Just In : Court To Rule On Nnamdi Kanu’s Bail Application November 17



Trial of the leader of the Indigenous People of Biafra, (IPOB) and Director of Radio Biafra, Nnamdi Kanu on Tuesday, November 8, suffered another setback, as the appellate court sitting in Abuja, adjourned the case to November 17.

During proceedings, Nigeria’s director of public prosecution, Mohammed Diri, applied for an amendment of the charges leveled against Nnamdi Kanu alongside his co-accused, Benjamin Madubugwu and David Nwawuisi.

But the defense counsel, Barrister Chuks Muoma (SAN), prayed the court to adjourn the hearing if an amendment must be made to the original charges.

After arguments for and against, Justice Binta Nyako held that the case before her is a fresh case and hence the proceedings continues.

Also during proceedings, Barrister Maxwell Okpara, a counsel to one of the defendants notified the court of the delay tactics of the Nigerian government to frustrate the trial, as he prayed the court to curtail excessive adjournment of proceedings.

Reacting to his prayer, Justice Binta ruled that ruling for the bail of the Biafran leader, Nnamdi Kanu and co-defendant filed by their legal team will be heard on November 17, 2016.

Meanwhile, Justice Nyako is the third judge handling the case against the Biafran leader. The first judge that handled Kanu’s matter was Justice Shuiabu Usman of a Magistrate Court in Wuse zone 2, Abuja, the second was Justice Adeniyi Ademola, who actually granted the IPOB leader bail.

Kanu alongside his co-accused, Benjamin Madubugwu and David Nwawuisi are facing a six-count charge of treasonable felony, brought against them by the Federal Government of Nigeria.

Although they have been granted bail twice by a federal high court sitting in Abuja, President Muhammadu Buhari’s led government has refused to obey the court orders raising doubts over the possibility of Mr. Kanu and his co-accused regaining freedom.
